What does this cover?

This covers the legal costs involved in obtaining a divorce decree from the Courts. That includes all costs associated with drafting any legal documentation and all court fees.

It does not cover any costs associated with financial matters, known as Ancilliary Relief. These would be dealt with separately and usually charged out at the fee earners hourly rate. Please see the relevant guides on Ancilliary Relief.

How does the divorce process work?

The first step is to lodge a divorce petition with the court. In the UK, grounds need to be given in order to obtain a divorce. The reason that needs to be cited is irretrievable breakdown. There are 5 facts which constitute irretrievable breakdown and they are:

• The other party has committed adultery and it is intolerable to live with them any more
• The behaviour of the other party is such that the petitioner cannot be reasonable be expected to live with them
• The petitioner has been deserted by the other party for a continuous period of at least 2 years
• The parties have lived apart for 2 years and both parties agree to the divorce
• The parties have lived apart for at least 5 years

The petition will be sent to the court along with a court fee.

It will then be served on the other party, who should acknowledge that they have been served with the petition.

In most cases the court shortly thereafter grant a Decree Nisi and set down a date for the Decree Absolute, that is the divorce certificate, which will be at least 6 weeks after the Decree Nisi.

How long will it take?

Generally, provided there are no complicating factors, it should take 4 - 6 months from lodging the petition to obtaining the Decree Absolute.
