Slips or trips on Public Highways

We walk down many footpaths and cross many roads, each day and never expect that we are going to trip and become injured.

However, if a hole or bump on the pavement, or in the road, causes you to trip or fall and sustain an injury, the effects can be devastating.

Most footpaths and roads are known as public highways, and the local highway authority (usually the Council) has a statutory responsibility to maintain them. The law gives the local authority a defence to claims for compensation if it can demonstrate that it took reasonable care to ensure that the highway was not dangerous to traffic.

In many cases this reasonable care boils down to a system of inspection and repairs that in some cases will have been adequate and in other cases not. Compensation will not simply become payable if the road was dangerous - the local authority must also have failed to have taken reasonable care to prevent it becoming dangerous.

To succeed with a claim for compensation it will be necessary to carefully review the local councils own records, and where possible cross reference them with witness evidence of any actual repairs and maintenance from local residents.

When you enter premises such a shop, a school, or even a pub, the owner of the premises has a legal responsibility to take reasonable care for your safety whilst you are there. In large stores there should be a clear health and safety policy understood and implemented by the staff at work. Even in smaller premises the owner or occupier should carry out a careful risk assessment to identity and remedy potential hazards.

You may have slipped and hurt yourself because there was no warning sign to tell you that the floor of a supermarket was wet. It may be that no warning is given of a steep step as you enter a changing room and you trip and fall.
