Immigration policy in the line of fire

Immigration rules in the UK require that in order to claim benefits, EU nationals must pass a ‘right to reside’ test. In the last few days the European commission has threatened legal action as it believes that the tests are too difficult and that many qualifying claimants are missing out.

This intervention from the Commission has heated up after an ongoing saga over the last couple of months and could lead to the UK being taken to the EU’s Court of Justice.
Ministers are now faced with one of the most interfering attacks from Brussels on Westminster which could mean a huge payout from taxpayers, hence burning an unexpected hole in the public coalition purse.

Work and pensions secretary Ian Duncan-Smith says, “These new proposals pose a fundamental challenge to the UK’s social contract. They could mean the British taxpayer paying out over £2billion extra a year in benefits to people who have no connection to our country and who have never paid in a penny in tax. This threatens to break the vital link which should exist between taxpayers and their own government.”

In a time of austerity and benefit cuts it makes for grim reality to the country and how the government chooses to handle the problem could put the whole immigration policy and laws in the UK under threat.

The Work and pension secretary continued said: “The EU settlement is supposed to protect the right of member states to make their own social security arrangements. But we are now seeing a rising tide of judgments from the European institutions using other legal avenues to erode away these rights, and we should be gravely concerned.”
