Main Injury : Asbestosis

Facts

The Claimant was employed by W.E. Chivers & Sons Limited in 1952.  He was employed to work on the building of the Aldermaston Site.

He was exposed to asbestos because part of his job was to cut up asbestos sheets and put them into a suspended ceiling on the site which was 15-16 square miles. He undertook this work all day every day for approximately 1 year.

The Claimant alleged that while acting in the course of his employment he inhaled injurious quantities of asbestos dust and fibre.

The Claimant was not diagnosed with asbestosis until 2012 at which time he was 78 years old.

The claim was eventually settled on a full and final basis.

Defendant : SSE Services PLC

Main Injury : Asbestosis

Facts

The Claimant alleged that whilst acting in the course of his employment he inhaled injurious quantities of asbestos dust and fibre, resulting in him developing asbestosis which he was diagnosed with in 2012.

The Claimant was employed by the Defendants originally in 1947 to 1949 when it was known as New Milton and Barton on Sea Electricity Supply. He was at the time an improver apprentice electrician and working on new build housing.

He was then employed again from 1953 to 1959, again working as an electrician on new housing contracts. At that time powdered asbestos would be delivered to site and it would be the job of either the electricians or the plumbers to mix up the asbestos and then to lag the hot water cylinders with it. The Claimant did this job approximately 6 times a week although it would vary somewhat, throughout his employment.  It was a particularly dusty job and he would be covered with asbestos dust when doing it. No warnings, training or masks were ever provided to the Claimant.

The Defendant had changed names but was still an active company. The insurers for the period in question were located and after negotiations on the value of the claim it was eventually settled on a full and final basis.

Defendant : British Uralite Plc

Main Injury : Asbestosis

Facts

The Claimant developed asbestosis as a result of being exposed to asbestos during her employment with the Defendants from 1960 to 1984.

The Claimant began to work for British Uralite in September 1960. She began working as a pipe moulder. This involved cement being emptied out of sacks and mixed with asbestos dust on the floor where she worked. In addition once the pipes had been made they also had the bottoms and tops of the pipes cut off on a lathe on the same floor. Both of these jobs would throw up a lot of asbestos dust to which the Claimant was exposed, throughout the entire working day.

The Claimant worked on the floor all day everyday and in fact would have lunch on the same floor as well. The Claimant initially worked as a pipe moulder then a checker and inspector and then a supervisor and finally a floor woman until she retired in 1984. All of these jobs involved her working on the same factory floor. The dust was continuously in the air and she would frequently leave the building with white hair.

In 1979 they introduced water spraying to try and keep the dust down and also the people working on the lathe and cleaning machines were given masks but non of the supervisors, which she was at that stage, were given masks.

The Claimant developed asbestosis. She was diagnosed in 2012 at which time she was 87 years old.

The insurers for the period in question were located and after negotiations on the value of the claim it was eventually settled on a full and final basis.

 

Claimant : Mr H

Defendant : Renault

Main Injury : Mesothelioma

Facts

The Claimant was employed by Renault and came into contact with asbestos during that employment.

The Claimant was not diagnosed with mesothelioma until 2012, when he was investigated for his breathlessness.  He was 62 years old. He had to take early retirement as a result of the mesothelioma.

The expedited procedure in London was used to ensure that the case was concluded swiftly. Following an early show cause hearing an interim payment was made in the sum of £50,000. Thereafter the claim was settled on full and final basis in the sum of £235,000.
