When somebody dies it is the job of their Executors appointed under a Will (or if there is no Will, one or more of their closest relatives, known as Administrators) to wind up the estate.

If some or all of the person’s assets are in joint names with somebody else, say their spouse and/or the value of any assets in their sole name is very low (say a few thousand pounds in a bank account) it is possible that a Grant of Probate (called Letters of Administration when somebody has not made a Will) is not needed. However, where a person has assets of a high value in their sole name, such as a property, Probate will be required.

Obtaining Probate enables the Executors to collect in all of the assets, such as closing bank accounts and selling the person’s property. They will then be able to distribute the assets in accordance with the Will (or if there is no Will in accordance with the Intestacy Rules).

If an Estate has a very high value – on current rates in excess of £325,000 – subject to certain exceptions (such as all or part of the estate passing to a surviving spouse or charity) Inheritance Tax is due and it is the Executors’ responsibility to pay this from assets of the estate.

At Kiteleys Solicitors we offer a number services to Executors.

For a fixed fee we can give you advice as to whether Probate is required. We can also offer practical advice as to what steps you need to take to wind up an estate as well as carrying out certain agreed work for you, such as arranging to register the death with the Land Registry.

If Probate (or Letters of Administration) is required, we can obtain this for you, but leave you to distribute the estate yourself. Depending on the size of the estate, we can usually do this for a fixed fee.

We can also deal with the whole of the administration of the estate on your behalf. This will involve us finding out the value of the estate by arranging a valuation of assets such as shares and the person’s property, as well as finding out how much is in their bank and building society accounts. We will then prepare the Probate papers and arrange to pay any Inheritance Tax which is due. We will then distribute the estate on your behalf as well as dealing with any Income or Capital Gains Tax issues.
