Domestic abuse is a pattern of controlling and aggressive behaviour from one partner (or ex-partner) towards another. The abuse can be physical, emotional, psychological, financial or sexual. The violence and abuse can be actual or threatened and can happen once every so often or on a regular basis.

Here are some of the important facts you need to know about:

  • Injunctions – If you need legal protection we can help you apply to the court for an injunction, which can provide a breathing space for you to recover and make decisions about the future.
  • Non-molestation Order – this is one type of injunction, which forbids the threat or use of violence and the use of intimidation, harassment or pestering. It can also prohibit specific behaviour. The court has to take into account all of the circumstances including the need to secure your health, safety and wellbeing and that of any children you may have. A non-molestation order is usually made for 6 or 12 months.
  • Occupation Order – this is another type of injunction, which can be obtained where significant harm to you or your children is likely. Occupation Orders are usually made for six months but can be extended and may include:
  • A requirement that your spouse or partner leave the home
  • Suspension of your spouse or partner’s right to occupy all or part of the home
  • Exclusion of your spouse or partner from a defined area around the home
