A fatal accident claim is a claim made as a result of someone’s death following an accident. The claim is made by a family member of a dependent of the deceased. This can be a husband or wife, children or a parent. The compensation awarded for fatal accident claims is made up of various parts. A dependency claim can be made under the Fatal Accident Act 1976 which is a claim for damages for the deceased’s family after the death. To be able to claim this you have to show that the deceased would have been entitled to bring a claim themselves had they not have died. The husband or wife of the deceased (or parents if the deceased was under the age of 18) can also claim a bereavement award.

Dependants of the deceased can also make a claim for their loss as a result of the deceased no longer being able to provide financially for the dependant. Details will need to be obtained as to the deceased’s income and expenditure in order to calculate an amount. Income does not just mean earnings, it can include pension benefits and other benefits provided through their employment such as accommodation.

When calculating a dependency claim the age of the deceased is also taken into account.

The amount the dependant will receive is also affected by State Benefits and other insurance policy payments. For example if the dependant receives a substantial insurance payout they may not suffer any financial loss compared to the income they would have received if the deceased had still been alive.
