Advanced Medical Decisions (‘Living Wills’)

A ‘Living Will’ is a document that addresses medical decisions should you be unable to make informed decisions about the healthcare you receive, whether through the result of an accident or disease.

Following changes in legislation, the validity of these documents has been enshrined in law, and allows you to in advance refuse certain courses of life-sustaining treatment. Usually, these types of documents are considered if your family has history of degenerative diseases and the type of treatments you would not be prepared to receive.

A key concern in receiving life sustaining treatment is whether a quality of life acceptable to you personally will be possible, even if the relevant treatment has been successful. A ‘Living Will’ allows you to address these concerns in an official document in the event of this treatment being received.

Once you have made a ‘Living Will’ it is a good idea for you to discuss the contents with family and your medical professionals in order to keep them fully updated as to your wishes.

Reviewing your ‘Living Will’ is vital, especially if you begin to suffer from a degenerative disease or your views change in light of medical advances. Any future amendments to your ‘Living Will’ should be prepared in the same manner as the existing document. Although a patient can revoke or amend their ‘Living Will’ (either orally or in writing) it is always advisable for any changes to be prepared by an independent solicitor.
