We aim to  be as clear and realistic as possible  from the start, when talking with you about how much our help will cost you.

Legal costs are in 2 main parts:

  1. Solicitors Costs – work undertaken by Kiteleys Solicitors, based on a fixed fee or hourly rate
  2. Disbursements  – costs which need to be paid to others, such as for a Barrister, Court fee, Property Valuation fee,  or Land Registry fee.

Kiteleys “General Terms of Business” require payment of invoices within 14 days. Also, it is usual for an advance “payment on account” to be required for Solicitors Costs and Disbursements.

However, we appreciate that people seldom plan to experience a family problem with requires help from a lawyer. Therefore, we shall help you consider the options for arranging payment of your legal costs which may include funding from:

  • Your own income or savings/investments – by Debit Card, Cheque or Bank Transfer.
  • A member of you family or a friend –  this could be either as a gift or a loan, which you will need to carefully discuss with the person providing the payment.
  • A Credit Card.
  • A Loan (whether secured or unsecured) from a Bank or other Lender regulated by the Financial Conduct Authority.
  • Insurance policy  – we recommend that you check whether any policies you have (eg. building, home contents, vehicle, life/critical illness) might provide financial support in your circumstances.
  • A Specialist Legal Costs Loan – Kiteleys Solicitors have arrangements which allow us to  help clients access loans from a supplier of litigation funding Novitas –  novitasloans.co.uk

NB: Kiteleys Solicitors cannot provide financial advice nor recommend a particular source of credit. You should very carefully consider all terms and conditions for any money you borrow.

  • Court fee remission – you might not have to pay the court fee if you qualify for remission. To see if this applies to you go to http://www.justice.gov.uk/courts/fees
  • Legal Aid –  this is when the Government pays your legal costs, but this is not always free because you might have to repay your legal costs at the end of your case. However, since 1st April 2013, Legal Aid is only available in limited circumstances:
    • To advise in support of Family Mediation and also pay the Mediator’s costs, or
    • when there has been sufficiently recent and serious domestic abuse, or
    • when there is evidence of child abuse,or
    • in Public Law Children Act cases, eg. a local authority taking a child into care,.

To qualify for Legal Aid you might also need to pass a means assessment and it is also important to know that Legal Aid is not available from all solicitors. Therefore, even if you do qualify for Legal Aid , you might find you have a restricted choice of the solicitor who can help you. Legal Aid is not available from Kiteleys Solicitors.

NB: Kiteleys are unable to provide Legal Aid funding. Any work undertaken is on a private fee paying basis.

  • A Legal Services Order and/or Interim Maintenance Order  – if you cannot pay your legal costs in any other way and your spouse/partner has money to spare (whether from capital or income) , then we might be able to help you apply to the Court to obtain an advance payment from your spouse/partner in order to pay for your legal costs.
