If you find that your marriage has not worked out as you had planned, Divorce is the formal process for bringing your marriage to an end.

  • Being married and then getting divorced affects inheritance. Therefore, make a Will or review any existing Will to be sure that what is yours goes to the right people when you die.
  • Being married and getting divorced may affect spousal pension benefits. Therefore, obtaining independent financial advice should form part of your plan when getting divorced.
  • You can divorce in the legal jurisdiction of England and Wales regardless of where you were married. However, you will need to produce evidence of your marriage, which can be difficult if you married abroad. Also, your right to start the divorce process in the legal jurisdiction of England and Wales can be affected by your nationality and how long you have lived in England/Wales.
  • The divorce process is formally started when a court document called a Petition is processed (“issued”) by a court office. This document will refer to the reason behind your divorce which may include adultery, unreasonable behaviour, desertion over a 2 year period, 2 years separation with mutual consent or 5 years separation without the need for mutual consent.
  • You remain legally married until Decree Absolute is granted at the very end of the divorce process. The grant of Decree Nisi is one stage towards finalising your divorce, but you are still married when Decree Nisi is granted and you must still wait at  least 6 weeks (possibly longer) before Decree Absolute can be applied for.
  • The divorce process itself will take 4 months at best from start to finish. However, it is usually advisable to delay the application for the grant of Decree Absolute until all financial matters have been fully and properly resolved. This means that if financial matters are not quickly resolved, the overall divorce process could take significantly longer than the quickest time of 4 months.
  • Resolving financial matters when your marriage breaks down can be done before you actually divorce or at the same time as your divorce. However, it is essential to remember that resolving financial matters is separate from the divorce process itself.

Fixed Price Undefended Divorce

  • Solicitors cost £850 plus VAT = £1,020
  • Family Court Fee = £550
  • Grand Total Fixed Price Divorce = £1,570

The fixed price divorce applies if your spouse cooperates with the divorce process by promptly completing and returning the divorce acknowledgement of service form, indicating that they do not defend the divorce process and providing their agreement where necessary.

If your spouse does not co-operate with the divorce process, then additional costs will apply beyond the £1,570  fixed price divorce which we will need to discuss with you.

You can ask that you spouse pays all or some of your divorce costs
